Karaikal Union Territory Struggle Group comprising representatives of DMDK,BJP,MDMK,BSP,INL met His Excellency The Lt.Governor Thiru.Mukut Mithiji at Rajniwas Puducherry on 13 th Feb 2008 and presented many memorandums on the law and order situation in Karaikal. Dravida Peravai urged the dismissal of Rangasamy Government for constitutional breakdown. Subject: Urging you to send Report to the Central Government on the constitutional failure in this union territory and recommend for imposition of President’s rule under Article 356 of Constitution of 1. It is needless to say that many decisions taken by the Chief Minister N.Rangasamy have no sanction of the cabinet and are not collective decisions that constitution provides to maintain checks and balances in a vibrant democracy. The open debate by many leaders of Congress party and the collective defiance of all cabinet ministers over the autocratic arrogant behavior of the first among equals in the cabinet floating all rules and regulations infringing the democratic right of a cabinet to decide collectively, clearly proves without an iota of doubt, even to the common man, that there is failure of constitution in this union territory. As custodian of our constitution in this union territory, you have the legal and moral authority to report to the Union Government on this constitutional breakdown, sorry a breakdown occurs accidentally but here hijacking the constitution to break the constitution had taken place. 2. The Chief Secretary of Puducherry had issued orders, as reported in the media that any expenditure above 10 crores have to get Center’s nod, and which again proves constitution has failed and financial irregularities of outgoing Chief Minister N.Rangasamy have reached uncontrollable proportions and is even beyond imagination in the whole history of governance in this country in north, east, west and south, since independence. People of Puducherry and all who are for responsible governance in public interest will welcome the orders of the Chief Secretary as temporary reprieve. It is the talk of the town that in inner party forums Health Minister had pleaded ignorance about a Medical college coming up in Chief Minister’s constituency which had planned to swallow 880 crores. Other colleges like PIMS have not exceeded 200 crores in budget how come Thathanchavady College alone needs 880 crores is a question that haunts every thinking person. While 500 fishermen lost lives in Tsunami in Karaikal a meager assistance was given there to deceased, and only other state governments and NGO’s provided houses. Where all Tsunami funds went, into whose coffers, does it includes oiling his party machinery nationally, all needs a probe. A permanent solution is to report to the Union Government to invoke Article 356 and dismiss the Government headed by N.Rangasamy. For one man’s failure the state machinery should not be in paralysis forever, unable to spend beyond 10 crores.We urge you to recommend to the Union Government for sacking this government, as well as ordering a CBI probe to retrieve the funds lost from State Exchequer and Tsunami loot. Let me quote: 356. Provisions in case of failure of constitutional machinery in States.—(1) If the President, on receipt of a report from the Governor of a State or otherwise, is satisfied that a situation has arisen in which the Government of the State cannot be carried on in accordance with the provisions of this Constitution, the President may by Proclamation— (a) Assume to himself all or any of the functions of the Government of the State and all or any of the powers vested in or exercisable by the Governor or any body or authority in the State other than the Legislature of the State; (b) Declare that the powers of the Legislature of the State shall be exercisable by or under the authority of Parliament We wish and hope you will not be a silent spectator to the failure of the Cabinet system here, and by such silence you will earn the wrath of future history of being a mute spectator to the plunder of National Exchequer and disruption of constitution from within, which we are sure will not happen, since you had been a Chief Minister of a State and will be definitely aware of your constitutional responsibilities. The memorandum of AIADMK Municipal Councilor Karthikeyan submitted in his absence attending his party meet in Chennai was circulated.Karaikal Districct Desiya Murpokku Dravida Kazhagam Secretary A.J.Asana, who lost last elections by a margin of 33 votes and who bore the murderous assault of Opposition Leader A.M.H.Nazim"s men submitted a memorandum. Karailal District BJP Vice President submitted his party"s memorandum. Karaikal Union Territory Struggle Group"s Vice Chairman V.S.Nallusamy and A.S.T.Ansari Babu presented a memorandum. All copies were given to media where local 30 TV channels crew too attended.MDMK Karaikal District Secretary Ambalavanan, Indian National League National President S.S.Hamid Maricar, BSP Karaikal District Secretary Sureshrajan all met Lt.Govenor, addressed press conference, handed over copies to media. Few published but Chief Minister"s men threatened, it seems the journalists fearing for life, had not published a demand seeking dismissal of the Rangasamy on valid constitutional grounds. |
